3. Description of Services

Kimera.ai provides AI event software that creates themed images from photos taken during events. Our service includes:- Creation of themed images using AI technology.- Secure storage of images on our servers for at least 14 days post-event.- Access to themed images via a unique event link provided to users.This link allows event participants to view and download their images during the 14-day period.

 

4. User Responsibilities

Users are expected to use the service responsibly and in accordance with these terms. This includes:- Respecting the intellectual property of Kimera.ai.- Not engaging in activities that could harm the service or other users.- Ensuring the images are used in a manner consistent with these Terms and Conditions.

5. Account Registration and Security

Currently, users do not need to create an account. Event participants will receive a unique link to access their images. It is the responsibility of the event organizer to ensure the link is distributed securely to authorized participants and not shared publicly or with unauthorized individuals. In the future, we plan to provide backend access for vendors to manage their accounts and settings. Vendors will be responsible for maintaining the security of their account credentials and ensuring all account activities comply with these terms.

 

6. Fees and Payment Terms

Payment for our services is required in full, two days before the event to confirm the booking. Payments are to be made via the methods specified in the invoice provided. Failure to pay the full amount by the deadline will result in cancellation of the booking and restricted access to the images.

 

7. Intellectual Property Rights

All images created are owned by the individuals who take the pictures. Kimera.ai retains ownership of the themed templates and AI-generated enhancements applied to these images. Users are granted a non-exclusive license to use the images for personal use only. Commercial use of the images without explicit permission from Kimera.ai is prohibited.

 

8. Privacy Policy

Kimera.ai complies with GDPR regulations to ensure the privacy and security of user data. Images and related data are stored securely and are only accessible via the event link for 14 days. After this period, images will be permanently deleted from our servers. We do not share user data with third parties without explicit consent, except as required by law.

 

9. User-Generated Content

Users are prohibited from:- Editing images or removing any logos or branding applied by Kimera.ai.- Sharing images that include other individuals without obtaining their explicit consent.- Using images in any defamatory, offensive, or illegal manner.

 

10. Prohibited Activities

Users must not engage in any activities that are illegal or misuse the service. This includes, but is not limited to:- Sharing images without proper consent.- Attempting to hack or disrupt the service.- Using the images for any unlawful purposes.

 

11. Disclaimers and Limitation of Liability

Kimera.ai provides the service 'as is' without any warranties of any kind. We do not guarantee the accuracy, reliability, or quality of the images. Once images are provided to the user, Kimera.ai is not liable for any misuse or unauthorized distribution of these images. Our liability is limited to the maximum extent permitted by law.

 

12. Indemnification

Users agree to indemnify and hold Kimera.ai, its affiliates, and employees harmless from any claims, damages, or expenses arising from their use of the service or violation of these terms.

13. Termination of Use

Kimera.ai reserves the right to terminate access to the service for any reason deemed reasonable by the company, including but not limited to, users engaging in illegal activities or violating these terms. Images are available for 14 days after the event, after which they will be deleted from our servers. In the event of termination, users will be notified via email.

These Terms and Conditions are governed by the laws of Israel. Users agree to submit to the jurisdiction of the courts in Israel for any disputes arising from these terms.

 

15. Changes to Terms

Kimera.ai reserves the right to modify these terms at any time. Users will be notified of any changes via email. Continued use of the service after such modifications constitutes acceptance of the new terms. Users are encouraged to review these terms periodically.
